1. WHO WE ARE
WiseWare BV operates WiseWare.chat, a private AI assistant platform for businesses. We help organizations deploy custom AI agents powered by their own files and knowledge. We comply with EU data protection laws including GDPR.
Roles:
- WiseWare acts as Processor for personal data processed in the WiseWare.chat platform on behalf of Customer organizations (governed by the Data Processing Agreement)
- WiseWare acts as Controller for website interactions, business contacts, billing, support, and service communications

2. INFORMATION WE PROCESS
Personal Data We Process
- Account Data: Name, email, authentication credentials, preferences, role assignments
- Platform Usage: AI agent configurations, conversation sessions, uploaded files and folders, generated content
- Technical Data: Usage patterns, performance metrics, security logs (for service improvement and security)
3. HOW WE USE YOUR INFORMATION
We process your personal data to:
- Provide AI agent platform functionality and user account management
- Process files and generate metadata for AI assistance
- Facilitate conversations between users and AI agents
- Provide customer support and improve our services
- Monitor security and ensure platform integrity
- Respond to website inquiries and provide service information
Legal bases (Controller activities): contract performance (account and billing), legitimate interests (service improvement, security, communications), and legal obligations (e.g., tax and audit).
4. DATA SECURITY
We implement appropriate security measures including:
- EU data storage (within the EU/EEA); AI model inference is performed via EU API endpoints, so your data is not transferred outside the EU/EEA for inference; your data is not used to train external AI models
- Encryption in transit and at rest
- Complete isolation between customer organizations
- Secure authentication and role-based access controls
5. DATA RETENTION
- Business data: Until deletion or 30 days after termination
- Technical logs: 12 months maximum
- Website analytics: Up to 2 years
6. AI PROCESSING
We use third-party AI models (OpenAI, Anthropic, Google, Mistral AI) to power custom agents and process your files. These models are accessed via EU API endpoints, so your data stays within the EU/EEA. We implement technical and contractual measures to prevent your data from being used for external AI model training.

7. YOUR RIGHTS
The platform provides self-service capabilities for managing your data. You also have the right to access, correct, delete, or export your personal data. Contact legal@wiseware.nl to exercise these rights. We respond within 30 days.
For data we process as Processor on behalf of your organization, please contact your organization’s administrator or data protection contact. We will support and, where appropriate, forward requests to the Controller pursuant to the DPA.
8. COOKIES
We use essential cookies for platform functionality (authentication, security, performance) and optional analytics cookies to improve our service. Analytics cookies can be controlled via your browser settings.
9. INTERNATIONAL TRANSFERS
We process data within the EU/EEA, including AI model inference via EU API endpoints. We do not transfer your personal data outside the EU/EEA.

10. DATA SHARING
We do not sell personal data. We may share data only with authorized sub-processors, when required by law, or to protect safety. Complete isolation is maintained between customer organizations.
We use authorized sub-processors to deliver the service; see wiseware.nl/legal/subprocessors for the current list. For platform processing on behalf of Customers, see the Data Processing Agreement.
11. CHILDREN’S PRIVACY
Our platform is for business use only and not intended for children under 16.
12. UPDATES
This Privacy Statement may be updated by posting a new version at wiseware.nl/legal. For service customers, updates to incorporated policies follow the Master Subscription Agreement.
13. COMPLAINTS
Contact our Data Protection Officer at legal@wiseware.nl or lodge complaints with your local data protection authority (Netherlands: Autoriteit Persoonsgegevens).
